Eesti Autoriõiguste Kaitse Organisatsioon (EAKO) loodi 1999. aastal võitluseks autoriõiguste rikkumisega Eestis. Organisatsiooni üheks eesmärgiks on filmi- ja muusikatootjate ning interaktiivsete mängude tootjate õiguste kaitsmine ning organisatsiooni liikmete esindamine.
EAKO koostööpartnerite hulka kuuluvad muuhulgas:
Motion Pictures Association of America (MPAA), kes esindab järgmisi Ameerika filmistuudioid: Columbia Pictures Industries, Inc., Disney Enterprises, Inc., Metro-Goldwyn-Mayer Studios Inc., Paramount Pictures Corporation, TriStar Pictures, Inc., Twentieth Century Fox Film Corporation, United Artists Pictures, Inc., United Artists Corporation, Universal City Studios LLLP, Warner Bros. Entertainment Inc.
International Federation of Phonographic Industry (IFPI), kes esindab rahvusvahelist fonogrammitööstust.
Tarkvaraettevõte Sony Computer Entertainment Europe Ltd (SCEE).
Nordisk Copyright Bureau (NCB), kes esindab muusikateoste salvestamise õigusi.
Käesolevaga pöördub EAKO Teie poole nõudega lõpetada aadresside http://twitter.com/eestiasi, http://www.facebook.com/eestiasi, https://eestiasi.wordpress.com/ vahendusel autoriõigusi rikkuva sisu levitamine ja sellise sisu reprodutseerimine hotfile.com ja teistesse failivahetuskeskkondadesse. Vastavate veebiaadresside vahendusel toimub Teie poolt autoriõiguse seadusega kaitstavate muusika- ja audiovisuaalsete teoste ilma loata levitamine, millega rikutakse autoriõiguste omajate õigusi.
Autoriõiguse seaduse (AutÕS) § 13 lg 1 alusel kuulub teose kasutamise (sh reprodutseerimise ja levitamise) ainuõigus teose autorile ja/või autoriõigusega kaasnevate õiguste omajale (AutÕS §-le 67, 70, 73 ja 73 primm 1). AutÕS § 46 kohaselt võib autoriõigusega kaitstud teoseid kasutada (sh reprodutseerida ja levitada, üldsusele kättesaadavaks teha) ainult autori või autoriõigusega kaasnevate õiguste omaja poolt eelnevalt antud loa (litsentsi) alusel.
Ilma autori või tema õiguste omaja loata teose levitamise eesmärgil reprodutseerimine ning sellisele tegevusele kaasaaitamine on käsitletav kuriteona KarS § 222 alusel, mis toob kaasa rahalise karistuse või kuni kolmeaastase vangistuse. KarS § 22 kohaselt kannavad süütegude toimepanemisel koos otsese täideviijaga vastutust ka süüteole kihutaja (isik, kes tahtlikult kallutab teise isiku tahtlikule õigusvastasele teole) ja kaasaaitaja (isik, kes tahtlikult osutab teise isiku tahtlikule õigusvastasele teole füüsilist, ainelist või vaimset kaasabi). Lisaks on kahjukannatanul õigus nõuda varalise ja mittevaralise kahju hüvitamist tsiviilkorras võlaõigusseaduse § 1043 alusel.
EAKO nõudmisel on varasemalt juba korduvalt suletud Teie poolt erinevatele veebiaadressidele üleslaetud autoriõigusi rikkuvat sisu, kuid sellele vaatamata olete tänaseni jätkanud õigustrikkuvat tegevust.
Käesolevaks ajahetkeks on EAKO kogunud piisavalt tõendeid tuvastamaks Teie isiksust ja tõendamaks Teie poolt toimepandud autoriõiguse rikkumisi.
Tulenevalt eelnevast palume Teil:

hoiduda edaspidi autoriõiguste rikkumistega seotud süütegude toimepanemisest või sellele kaasaitamisest, kihutamisest.
Juhul kui Te jätkate peale tähtaja 19.10.2010.a möödumist autoriõigusi rikkuvat tegevust ükskõik millises vormis või ükskõik millisel viisil, oleme kohustatud esitama Lääne Prefektuurile kuriteoteate koos kõigi olemasolevate tõenditega Teie isiksuse ja autoriõigusi rikkuva käitumise kohta eesmärgiga Teid kriminaalkorras vastutusele võtta.
Autoriõigusi rikkuva käitumise lõpetamisel, loeme antud kaasuse lõppenuks ega rakenda õiguskaitsemeetmeid Teie poolt varasemalt toimepandud autoriõiguse rikkumiste osas.
